NCAA Season 84: July 18, 2008 Game officially forfeited

The Management Committee after hearing the protest filed by the College of St. Benilde and based on the facts found as presented both by the protestor (CSB) and Mr. Sam Ekwe, established that rules 6.1 and 6.5 have been infringed and as prescribed for by rules 9, 9.1 and 9.2 of the NCAA manual of operations decided on the forfeiture of the July 18, 2008 played game of San Beda College and College of St. Benilde. The results will be adjusted accordingly.

its sad to read comments that are not words coming from people who have studied from the best cathollic or / individuals names will not resolve the issue.
lets stick to the issue. i myself am not for forfeiture of the win of SBC to CSB but as the saying goes, rules have been made and rules should be followed. if we dont, we are showing the youth the worst in us.
come on, write NCAA and UAAP to change the rules and the punishment for wrong uniform worn by a player for the next season. maybe a less harsh punishment can be imposed such as a 2 game suspension for the player involved…….
sports are supposed to bring out the team/school spirit in our youth including teaching them sportmanship. since most of us who write our comments are spectators, its best we allow the leagues, teams, schools and the players to resolve the issues among themselves. lets not add fuel to the fire with un-christian comments.

yng sa ateneo issue kasi di na nag protesta yng UP, kasi yung suot naman ni long ska ni burke eh yung 2008 jersey nila. yung patch lang ng smart yung wala
anyway, sa amin(csb) na pala napunta yng panalo pero di ako masaya. mas lalong maraming nang lait kasi sa school ko kaya lng rules are rules eh kung baligtad yng sitwasyon at yng player namin nag suot ng wrong jersey SURE! sa inyo na yng panalo wala kaming sasabihin na kung anu-ano pa kasi nga may rules na sinusunod sa ncaa. at saka marunong kaming makatanggap ng talo basketball lang yan. next time ibahin niyo na kasi yng design ng jersey niyo.

@miguel, unfortunately, some of the commentators here did not imbibe the christian learnings their school taught them. it seems that basketball, especially a lost game, brings out the devil in them. iba yung pang-asar, yung bragging rights sa kabastuhan and uncouth and foul mouthed behaviour seen in some comments here. yung mga ganun, they deserve to recieve the sanme trash they dish out.

He immediately informed the Coaching Staff. Instead of bringing up the matter to the their Mancom Representative, the Coaching Staff took it upon themselves to instruct him to use the old uniform and that they would take care of “the problem”. Therefore, they obviously knew that what they where doing was against the Rules.”

For the case of Ateneo, UP didn’t bother to file a protest since ADMU won convincingly…certainly the main difference between UP and CSB is….Brains!

I don’t think the threepeat is in jeopardy at all since at this point, it will surely be Letran Knights, San Beda Red Lions and Mapua Cardinals going to Round 2.
Meron chance na makapasok ang CSB Blazers just because of the default win. But they have to win against San Sebastian Stags first or JRU Heavy Bombers will go to Round 2.

sinadya ata ng csb side na i file ang case after the game kasi siguradong talo sila at alam nila na wrong uniform si ekwe kaya hinayaan nila at di na sila masyadong nagpagod sa laban dahil alam nila na ma foforfeit ang laban. kahit nakikita na nila na naglalaro si ekwe ng may maling uniform. sana nagreklamo sila during the game. pwede nmn yun eh diba?

Tama lang ang ginawa niyo. Nagkamali naman talaga ang beda eh. Isuot ba naman ang bantay bata jersey e. Hindi naman yun yung uniform nila for 2008 e. So wrong uniform nga talaga sinuot ni ekwe. Malinaw naman sa rules na kapag iba ang sinuot mong uniform sa prescribe uniform e wrong uniform un. Tsaka papano pa magiging uniform un kung iba ung suot ng isa. Kayang nga UNIform e. Simpleng explanation lang hindi pa maintindihan ng ibang mga bedans dito.

Here’s the letter of Henry R. Atayde, CSB Representative to the NCAA Mancom, you referred to in your 12:42 pm today:

Dear Lasallian Community,
On behalf of CSB, we would like to thank all of those who supported our protest versus San Beda College (SBC).
All of the comments helped us look at all the different areas, that we may have missed out, and thus assisted us in our preparation for our formal letter which we submitted on July 22, 2008.
You have encouraged us with our decision that we were doing the right thing, which from the very beginning was to abide, uphold and respect the NCAA rules, even at the risk of being ridiculed and looked down upon.
The column of Mr. Quinito Henson, although hurtful, actually helped our case. As stated in his article, there was an admission from SBC that the uniform used by Sam Ekwe was indeed from the previous season, which according to the NCAA rules is not allowed.
During the 2 hr meeting held last night at Aloha Hotel, because of the said article, Mr. Sam Ekwe had no choice but to admit that before going to the game, he realized that his uniform was “stolen”. He immediately informed the Coaching Staff. Instead of bringing up the matter to the their Mancom Representative, the Coaching Staff took it upon themselves to instruct him to use the old uniform and that they would take care of “the problem”. Therefore, they obviously knew that what they where doing was against the Rules.
I would also like everyone to know that on the same day, in the morning, when our LSGH Jr. Team was about to play against San Beda, we noticed that one of our good players brought the wrong uniform. Being aware of the Rules, our Coach made him stay in the locker room and had his correct uniform picked up. The uniform arrived at the end of the second quarter; only then was he allowed to step into the playing court. By the way, we beat San Beda by more than 10 points.
Our Sr. Volleyball Team also has a pending protest case because of a misspelled name. The protest was filed by JRU. This will be discussed next week.
As what we mentioned in our protest letter, during Season’83, our LSGH Jr. Teams suffered forfeiture in Table Tennis, Lawn Tennis and Chess because of wearing the wrong uniforms. In the Senior’s Division for Track and Field, the javelin thrower of San Sebastian likewise suffered the same fate. All his throws where he wore the wrong pair of shorts were nullified.
We presented photos of the SBC Sr. Basketball Team during Season ‘83 and compared them to Season ‘84. There were also other evidences that were irrefutable which we are not allowed to divulge.
The gist our protest letter was to request for the NCAA Mancom to be consistent with its decisions and to uphold the rules and regulations given to us before the start of the tournament, as it has done in the past. It was never our intention to file a protest to “take advantage” of the situation and “to win at any cost”. No doubt SBC is a strong team and had dominated us, but rules are rules. They were created to be followed and not treated as “suggestions”.
During the NCAA Mancom meeting, I stated that it was CSB’s decision that if SBC’s win were to be forfeited, CSB would not take the win. The College of St. Benilde believes that through sports, we must continue to instill the values of fair play, honesty, respect, obedience and discipline to its student athletes on and off the playing field. This is what we Lasallians are all about… to always do the right thing

Palpak San Beda’s defense. That’s the problem with offense-minded players. I hope the team will put more emphasis next time on team defense. Asa lang ng defense kay Ekwe sa loob, eh pano yong 3 point shooters? A 1-3-1 defense or better man-to-man dapat against a three-point shooting team hindi zone defense.

It’s been a very inconsistent performance so far for the Red Lions. Obviously, they are not themselves, as if they are in another dimension. You are correct, that they should step up on team defense. The reason why, they went to a 2-3 and 3-2 zone is because of the big men’s failure to control the shaded area, counter the excellent ball movement by JRU and answer the lack of help, rotation and accountability from one another
As I have said before in my previous articles and comments, that Sam Ekwe has to improve his one-on-one defense(single coverage). At that game against JRU, San Beda had nothing on almost every department.

Nope, I think one big factor in the JRU win, was because they got lucky from the 3-point area. Consider this: JRU only shot thirty percent from the three-point area, hitting twelve out of forty shots. Out of those twelve made shots, six came at the last five minutes of the game. That means the other six made shots were taken from the first three quarters. So for the first three quarters, JRU was hitting around six out of thirty-four shots, a very low percentage.
So if you were an SBC defender, you’d think: Why the heck are these guys throwing 3-point shots, even if they were missing them? The answer was that JRU was betting on the law of averages from the three-point area. The law of averages states that you cannot shoot such a high percentage, or such a low percentage for certain duration. Sooner or later, you will start missing shots if you were shooting very well, or you will start making shots if you were shooting poorly. JRU was shooting so low in the first 3 quarters, that the law of averages says it has to rise up, in this game, or the next game/s. Just our luck, that it rose up in this game.
It takes a gambling coach to keep telling his players the keep throwing three-point shots, even if they were missing most of it in the first three quarters. And I think Ariel Vanguardia gambled on the three-point shot in this game. He probably thought, everybody expected us to lose in this game, so why not bet on the 3-point shot? If we lose, then that’s expected. But if we win …. and they won. The 3-point shots went in.
But its more of a one time thing, though. That kind of a gamble doesn’t work every game. It doesn’t even work on MOST games. If I were Frankie, though, I’d keep a close watch on those law of averages also, especially where the opponent is taking the shot.

The decision has been handed down. It should be respected.

Otherwise, continuing the controversy may open up a can of worms that may have disastrous consequences for the team.
The decision states that Ekwe violated among others, rule 9.2.1
9.2.1 states – “An INELIGIBLE athlete is fielded or enters the playing court with an intent to play. He and his team shall lose the game/match BY FORFEITURE. The particular player shall be BARRED from further competition in any NCAA tournament. Moreover, the games with the team in which he played are automatically FORFEITED.�
The decision further states that “(9.2.1 applies only to that particular played game last July 18)�
Note that ASIDE for forfeiture, the other penalty for 9.2.1, is the BARRING of the particular player from further competition in any NCAA tournament.
The penalty of forfeiture is specific only for the July 18 games.
But the BARRING of the player is permanent. The rule does not say that the BARRING is specific only for a particular game.
It says the BARRING is from further competition in any NCAA tournament.
Therefore, if Ekwe plays again, the losing team can raise the issue that a BARRED player was used, That game is again subject to forfeiture. The rule states–”…Moreover, the games with the team in which he played are automatically FORFEITED.â€?
(CSB, hint ‘yan for another forfeiture kung matalo uli kayo sa 2nd round).
So let’s end the discussion on this controversy and keep this secret amongst ourselves.

I didn’t know that the penalty includes being barred from further competition in any NCAA tournament.
This says that Ekwe cannot play in the NCAA anymore.

it wasn’t ekwe’s fault. he told his coach he doesn’t have his uniform. still his coach let him play with the wrong one. it was his team’s fault and not ekwe’s alone. his team suffered the consequence of their actions. sbc could still have beaten csb if ekwe was not fielded in.
and as for csb, they were just making sure rules are enforced. this issue and its quick resolution benefited the ncaa as a whole. at least in the ncaa, rules are not made to be ignored.

JRU came in well prepared, full of passion with a big heart to win. They won the game fairly, no excuses, we lost. We hope to learn from this lost so that adjustments can be made in the succeeding games. The loss gave us an opportunity to rally bedan crowd support until the end of the season.
Going to SBC’s forfeiture - Feeling of suspicion will loom over the underlying intentions of NCAA MANCOM’s decision on SBC game forfeiture if the following matters were not imputed to the decision process:
1. Who initiated insertion of infraction to the tally sheet in behalf of unknowing CSB coaching staff?
2. Why was the infraction not raised during the game by the opposing team?
3. Is it possible that the infraction has been noticed already by the initiator of the protest during the game but for some reasons with-held it until the opportune time to facilitate filing of protest?
4. Is it possible too that the some of the initiator/s are decision makers too? what motivated them? How much did they influenced the outcome of the decision?
5. Why did UP took a different path for the same infraction at UAAP?
6. Factoring worthy considerations for an impartial decision, or perhaps a lesser sanction; does the policy serves it purpose to promote fairness and sportsmanship? What lessons are we imparting? Are we sending the right signals?
Answers to these questions will matter most in coming out with an impartial and graceful decision for MANCOM. Otherwise, I believe, it is just fair to elevate for a reversal of the forfeiture decision to the NCAA Policy Board.

I don’t have answers to all your questions but I will answer those I can:

I don’t know. But who put it there is not relevant because the tally sheet was signed with the intent to lodge a protest by CSB.
2. Why was the infraction not raised during the game by the opposing team?
Because both the CSB and the game officials didn’t notice it. Maybe if SBC informed them beforehand that Ekwe was wearing the wrong uniform they would have.
3. Is it possible that the infraction has been noticed already by the initiator of the protest during the game but for some reasons with-held it until the opportune time to facilitate filing of protest?
No, as I said in the previous question, the CSB and the game officials did not notice that Ekwe was wearing the wrong uniform so they could not have withheld information they didn’t have.
But whether or not the knowledge of the infraction was withheld is not important.
What is important to ask is why the SBC coaching staff instructed Ekwe to wear the wrong uniform and yet DID NOT tell the game officials.
4. Is it possible too that the some of the initiator/s are decision makers too? What motivated them? How much did they influenced the outcome of the decision?
Mancom is the body that deliberates and decides protests. It is composed of nine members (one from each of the member schools and a League Chairperson), each member is entitled to one vote.
To answer your first question, I don’t know because I’m not familiar with the separation of powers of the Mancom and the other NCAA bodies.
When the Mancom decides on the protest, the reps of the schools involved (in this case SBC and CSB) DO NOT PARTICIPATE in the voting. So, the answer to your third question is Zero.
5. Why did UP took a different path for the same infraction at UAAP?
I don’t know, they didn’t say.
Besides, we cannot say if the infractions are the same because (1) the NCAA definition of an improper uniform may be different from the UAAP’s and (2) Ekwe used the wrong uniform while Burke and Long used the correct uniform that had missing sponsor logos.

Yes, I think it does (and did) promote fairness and sportsmanship.
For the fairness part, the Mancom discovered (through the revelations of Ekwe) that the SBC coaching staff intentionally kept from the game officials the fact the Ekwe played wearing the wrong jersey. I think it fair then that SBC was penalized for it.
On the sportsmanship part, first and foremost, sportsmanship is about following the rules. Look at any Athlete’s Oath and you’ll find it stated as the first paragraph. And the Mancom’s decision to penalize SBC was a strict and consistent implementation of the rules.
So, what lessons did we learn from this? Two very important ones: play fair and follow the rules.
Are we sending the right signals? Of course, because justice was administerd without fear or favor.
On a side note:
You are right, there are several in this forum implying that a conspiracy was the cause of SBC forfeiting the game. Rest assured it is not true. SBC intentionally fielded a player wearing the wrong uniform, was caught, and penalized for it. No ifs, no buts.

@LDC, Barring is also a penalty provided under 9.2.1. Whether to invoke that by teams playing against sbc in future games is up for them. Using a barred player makes the game forfeitable. But since the poor guy ekwe has been judged to violate the rule, that is an appicable sanction. No test case yet. I hope they don’t invoke that during the finals if ever the lions participate therein. Sana earlier so at least they won’t be forfeiting games, if ever.
For me, just let the teams play ball. There is no need to unduly handicap the lions. For though they are a strong team, the others have stepped up. It would be open season in the 2nd round.

@LDC, it is irrational but that is what is stated in the rule. kaya the sword of damocles hangs on the lions’ heads. i think csb just opened up the pandora’s box on this one. pero in the spirit of the games, sana this case is closed. but i feel in the warped spirit of winning by some, this may not be not the end of this. sabi once pandora’s box is opened, it can never be closed.

@LBC, i don’t know the reason for the rule, whoeever made it up. but the penalty is clear. a sword of damocles now lies on ekwe’s head. any team cxan opt to chop his head off.
i think csb opened up pandora’s box on this one, that may never be closed.
i hope other ncaa teams will not invoke the rule in the spirit of sportsmanship. pero, in the prevailing warped sense of winning at all cost, this may crop up again in the future.
dapat yung mga nagpalaro kay ekwe, knowing he was in violation of the rule, dapt all of them should be burned at the stake.
